By using the Platform, you represent that:

• You are at least 18 years of age
• You are using the Platform for lawful business purposes
• The information you provide is accurate and complete
• You have the authority to enter into these Terms on behalf of yourself or your business

3. Platform services

nanoReach provides a paid creator directory service. The Platform allows brands to:

• Browse creator profiles (partially visible on free access)
• Pay to unlock creator Instagram profile links
• Contact creators directly via Instagram to commission content

4. Accounts and access

Currently, the MVP Platform does not require brand account creation. Access is granted upon successful payment verification. You are responsible for safeguarding your access details. We reserve the right to restrict or revoke access in case of misuse.

6. Creator profiles — data accuracy disclaimer

Creator profiles on nanoReach are sourced from publicly available Instagram data and manually curated. While we make reasonable efforts to ensure data quality, we do not warrant that:

• All creator details are accurate, current, or complete
• All listed creators will respond to brand outreach
• Creator follower counts, engagement rates, or niche details are fully up to date

We perform activity checks and add fresh profiles weekly, but real-time accuracy cannot be guaranteed. Reliance on creator data for business decisions is at the user's sole discretion.

7. Prohibited conduct

You agree not to:

• Scrape, copy, or redistribute creator data obtained from the Platform
• Use creator contact details for spam, harassment, or unlawful purposes
• Attempt to reverse engineer, disable, or tamper with the Platform
• Share your paid access with unauthorised third parties
• Misrepresent your identity or business purpose to creators or to the Platform
• Use the Platform for any purpose that violates applicable Indian law

8. Intellectual property

All content, design, branding, and data on the Platform is the exclusive property of Labhakarini Infotech Private Limited or its licensors. You are granted a limited, non-exclusive, non-transferable licence to access and use the Platform for its intended purpose only. No rights are transferred to you by virtue of using the Platform.

9. No guarantee of results

nanoReach provides a discovery and connection tool. We do not guarantee:

• That any creator will respond, accept a brand's commission, or deliver content
• That content produced by a creator will meet the brand's expectations
• That use of nano creators will result in any specific business outcome or ROI

All business decisions made based on the Platform's data are the sole responsibility of the user.

10. Third-party platforms

The Platform links to Instagram profiles owned by third parties. We have no control over the content, availability, or conduct of creators on Instagram. By clicking a creator link, you leave the nanoReach Platform and engage with Instagram, which is governed by Meta's own Terms of Service.

11. Payments

All payments are processed via Razorpay. By making a payment, you agree to Razorpay's Terms of Service and Privacy Policy. We do not store or have access to your payment card information. All transactions are in Indian Rupees (INR).

12. Refund policy

All sales are final. No refunds are provided for digital products once access is granted. Please review our Refund & Cancellation Policy for complete details.

13. Limitation of liability

To the maximum extent permitted by applicable law, Labhakarini Infotech Private Limited and the nanoReach brand shall not be liable for:

• Any indirect, incidental, special, or consequential damages arising from your use of the Platform
• Loss of business, revenue, data, or goodwill
• Actions or inactions of creators contacted via the Platform
• Any errors, omissions, or inaccuracies in creator data

Our total liability under these Terms, in any event, shall not exceed the amount you paid for the specific plan that gave rise to the claim.

14. Indemnification

You agree to indemnify and hold harmless Labhakarini Infotech Private Limited, its directors, employees, and agents from and against any claims, liabilities, damages, losses, or expenses arising out of your use of the Platform, violation of these Terms, or infringement of any third-party rights.

15. Modifications to the platform and terms

We reserve the right to modify, suspend, or discontinue any part of the Platform at any time without notice. We may also update these Terms at any time. Continued use of the Platform after updates constitutes your acceptance of the revised Terms. The latest version will always be available on our website.

16. Governing law and dispute resolution

These Terms are governed by the laws of India. Any dispute arising from or relating to these Terms or use of the Platform shall first be attempted to be resolved through mutual negotiation. If unresolved, disputes shall be subject to the exclusive jurisdiction of the courts in Haridwar, Uttarakhand, India.

17. Severability

If any provision of these Terms is found to be unlawful or unenforceable, that provision shall be severed without affecting the remaining provisions, which shall continue in full force and effect.

18. Entire agreement

These Terms, together with the Privacy Policy and Refund & Cancellation Policy, constitute the entire agreement between you and the Company regarding your use of the Platform.
